  • use our product and services;
  • and when you use any other websites or services that link to this Privacy Policy (for example our other brands such as the Construct Studios).

This Privacy Policy describes how we collect, receive, use, store, share, transfer, and process your personal data. This Privacy Policy also describes your choices and rights with respect to your personal data, including your rights of access and correction of your personal data. For the purposes of this Privacy Policy “Personal Data” means any information relating to an identified or identifiable individual. If you do not agree with this Privacy Policy, you should not use our websites, products and services, or any other sites or services that link to this Privacy Policy.

We periodically update this Privacy Policy. We will post any privacy policy changes on this page.

When you interact with us via our websites or any sites or services that link to this Privacy Policy (including constructeducation.com and construcstudios.com), we may collect personal data and other information from you, as further described below.

When You Visit Our Websites

We collect personal data from you when you submit web forms or interact with our websites, for example by subscribing to our newsletter, signing up for a webinar, or requesting support. We may ask for your email address, first and last name, job title, and other similar business information. You are free to explore some of our websites without providing any personal data about yourself. 

Event Information

When you register for a Construct event, (example a webinar), we collect information such as name, address, phone number, and email address. We use this information to communicate with you and in some cases facilitate your registration. 

Payment Information 

We collect payment and billing information when you enter into a contract for paid products or services. For example, we may ask you to provide a billing address or a billing contact for your account. If you give us payment information, we use it solely as authorized by you in accordance with this Privacy Policy. 

Customer Testimonials 

We post customer testimonials and comments on our websites, which may contain personal data. We obtain each customer’s consent via email or through other agreements between customers and Construct before posting the customer’s name and testimonial.

b. Information we Collect From Other Sources

Use by Third Parties

Construct Education uses the HubSpot Subscription Service to generate marketing campaigns that people can use to learn more about our business. HubSpot processes our customers’ information in accordance with our agreements and directives, but HubSpot does not have control over our data collection or management. Our agreements with HubSpot prohibit them from using that information, except as necessary to provide and improve the subscription service, as permitted by HubSpot’s Privacy Policy, and as required by law.

a. When You Visit Our Website

You are free to explore the websites without providing any personal information about yourself. When you visit the websites, we request that you provide personal information about yourself, and we collect navigational information.

Personal Information

This refers to any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, e-mail address, company name, address, phone number, and other information about yourself or your business. Personal information can also include information about any transactions, both free and paid, that you enter into on the websites, and information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter, and Google, or publicly available information that we acquire from service providers.

Personal information also includes navigational information where such information can directly or indirectly identify an individual. Navigational information refers to information about your computer and your visits to this website such as your IP address, geographical location, browser type, referral source, length of visit, and pages viewed. Log Files

When you use our services or view content provided by us, we automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times, and referring website addresses. This information is used by Construct Education to maintain the quality of our marketing services and to provide general statistics regarding the use of the website(s). For these purposes, we do link this automatically-collected data to personal information such as name, email address, address, and phone number.

Information we Collect From Third Parties

From time to time, we may receive personal information about you from third-party sources including partners with which we offer co-branded services or engage in joint marketing activities, and publicly available sources such as social media websites or through webinars.

Information About Children

The websites are not intended for or targeted at children under 16, and we do not knowingly or intentionally collect information about children under 16. If you believe that we have collected information about a child under 16, please contact us at generalcounsel@constructeducation.com, so that we may delete the information.

We use the information we collect only in compliance with this Privacy Policy.

b. We Never Sell Personal Information

We never sell your personal information to any third party.

c. Use of Personal Information

In addition to the uses identified elsewhere in this Privacy Policy, we may use your personal information to:

  • improve your browsing experience by personalizing the websites and improving our services;
  • send information or content to you which we think may be of interest to you by post, email, or other means, and send you marketing communications relating to our business;
  • promote the use of our services to you and share promotional and informational content with you in accordance with your communication preferences;

We use navigational information to operate and improve the websites. We may also use navigational information alone or in combination with personal information to provide you with personalized information about Construct Education.

We post customer testimonials and comments on our Websites, which may contain personal information. We obtain each customer’s consent via email prior to posting the customer’s name and testimonial.

g. Applicants for Employment

In general, personal information is requested when you contact us to look for employment or to search for a candidate to fill a job opening. We ask applicants for their names, addresses, and other personal information such as work experience, education, and skills. When hiring employees, we may also request personal information that is considered “sensitive,” such as information necessary to provide health benefits.

When you apply using our electronic application or through an external website which then forwards your data to Construct Education, we may ask you for your name, e-mail address, or other personal information such as work experience, education, and skills. We may use this information to assess your qualifications and/or contact you.

h. Security of your Personal Information

We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure.

i. Social Media Features

Our websites include social media features, such as the Facebook like button and widgets, and the “Share This button” or interactive mini-programs that run on our sites. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.

j. External Websites

Our websites provide links to other websites. We do not control and are not responsible for the content or practices of these other websites. Our provision of such links does not constitute our endorsement of these other websites, their content, their owners, or their practices. This Privacy Policy does not apply to these other websites, which are subject to any privacy and other policies they may have.

k. Retention of Personal Information

How long we keep the information we collect about you depends on the type of information, as described in further detail below.

We retain personal information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as it is required in order to contact you about our services, or as needed to comply with our legal obligations, resolve disputes, and enforce our agreements).

When we have no ongoing legitimate business need to process your personal information, we securely delete the information or anonymize it or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible. We will delete this information from the servers at an earlier date if you so request, as described in “To Unsubscribe from Our Communications” below.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.

4. How we Share Information we Collect

a. Service Providers

We employ other companies and people to provide services to visitors to our websites and may need to share your information with them to provide information, products, or services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis, providing marketing assistance, supplementing the information you provide us in order to provide you with better service, and providing customer service or support. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and customer data handling policies.

b. Trusted Partners

We may share data with trusted partners to contact you based on your request to receive such communications, help us perform statistical analysis, or provide customer support. Occasionally, we may partner with trusted third parties to provide you with co-marketing content that we think may be relevant to you. c. Corporate Events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy, or otherwise, that company would receive all information gathered by Construct Education via our websites. Construct Education uses cookies or similar technologies (such as web beacons) to analyze trends, administer the website, track users’ movements around the website, and gather demographic information about our user base as a whole. b. Flash Cookies and Other Third Party Tracking Technologies

The Adobe Flash Player (and similar applications) use technology to remember settings, preferences, and usage similar to browser cookies, but these are managed through a different interface than the one provided by your web browser. This technology creates locally stored objects that are often referred to as “flash cookies.” Construct Education does not use flash cookies.

c. Advertising

We partner with a third-party ad network to either display advertising on our website or to manage our advertising on other sites. Our ad network partner uses cookies and web beacons to collect information about your activities on this and other websites to provide you with targeted advertising based on your interests. If you are visiting our website from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that Construct Education does take steps pursuant to laws in the United States to ensure that your privacy is protected.
